These Terms of Service ("Terms") govern your access to and use of the MTSRE LLC website and rental services (together, the "Service"). By requesting a quote, booking a rental, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
MTSRE LLC ("MTSRE", "we", "us", or "our") provides heavy equipment rental services for contractors. Unless a separate written rental agreement is in place between you and MTSRE, your rental is governed by these Terms together with our Rental Agreement.
You may use the Service only if you are at least the age of majority in your jurisdiction and can form legally binding contracts. If you are acting on behalf of a business, you represent that you have authority to bind that business to these Terms.
Equipment listings, descriptions, and pricing shown on our website are provided for general information and may change without notice. A quote issued by MTSRE is an invitation to book, not a binding offer. A rental is confirmed only when MTSRE accepts your booking in writing. Availability of any item is not guaranteed until confirmation.
When you book equipment, your rental is subject to our Rental Agreement, which describes your obligations regarding payment, equipment use, maintenance, return condition, and liability. By accepting a booking you agree to be bound by the Rental Agreement. In the event of any conflict between these Terms and the Rental Agreement for a specific rental, the Rental Agreement governs that rental.
Operating heavy equipment is inherently dangerous and may cause serious injury, death, or property damage. By renting equipment from MTSRE you represent and warrant that:
You agree to provide accurate, current, and complete information when requesting quotes or making bookings, and to keep it up to date. You are responsible for all activity that takes place using your contact details or account, and you must notify us immediately of any unauthorized use.
All content on our website — including text, logos, images, and layout — is owned by or licensed to MTSRE and protected by intellectual property laws. You may not copy, reproduce, or redistribute it without our written permission, except as needed to view the site.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, MTSRE disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Equipment descriptions are provided in good faith but we do not guarantee that any item meets your specific requirements.
To the fullest extent permitted by law, MTSRE and its affiliates, officers, employees, and suppliers shall not be liable for any indirect, incidental, consequential, or special damages, or for any loss of profits or business, arising out of or relating to your use of the Service or any rental. Our aggregate liability for any claim arising from a rental shall not exceed the amount you paid us for that rental.
You agree to indemnify and hold MTSRE harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of equipment, your breach of these Terms, or your violation of any law or third-party rights.
Where required by your rental, you must obtain and maintain adequate insurance — including general and auto liability coverage — for the full rental period, and name MTSRE LLC as an additional insured. We may request certificates of insurance before releasing equipment.
We may suspend, restrict, or terminate your access to the Service at any time, with or without cause or notice, and shall not be liable for any resulting loss. Upon termination, all outstanding amounts you owe become immediately due.
We may update these Terms from time to time. If we make material changes, we will give reasonable notice before they take effect. Your continued use of the Service after a change constitutes acceptance of the revised Terms.
These Terms are governed by the laws applicable to the jurisdiction in which MTSRE LLC is formed and operates, without regard to conflict-of-laws principles. You and MTSRE consent to the exclusive jurisdiction of the courts in that jurisdiction for any dispute arising from these Terms.
These Terms, together with any Rental Agreement and quote applicable to a booking, constitute the entire agreement between you and MTSRE regarding the Service and supersede all prior understandings and communications.
